IN SIMPLE TERMS:

AdmitStudio.com provides tools and guidance to help strengthen your MBA applications, but we cannot promise admission to any school. The MBA application process involves many factors beyond our control. Our platform contains our best professional opinions and information, which we strive to keep accurate, but you should always verify important details directly with the schools. Your application materials remain your intellectual property, though we need permission to process them to provide our services. Each account is for a single person only - sharing accounts violates our terms. We've invested significant resources in developing this platform, so please respect our intellectual property rights. If you encounter any issues with our service, please contact us directly first so we can address them. Our goal is to make the application process more manageable and effective, but success ultimately depends on your qualifications and efforts.

1. Agreement to Terms

By accessing or using the AdmitStudio.com website and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and AdmitStudio.com ("we," "us," or "our"). If you do not agree with any part of these Terms, you must not use our Services.

2. Service Description

AdmitStudio.com provides a platform designed to assist users with MBA applications through guidance, tools, and resources. Our Services include but are not limited to essay feedback, resume review, profile assessment, and application strategy guidance. The information and opinions provided through our Services represent our professional judgment but should not be considered guarantees of admission or success. You acknowledge that admission decisions are made solely by educational institutions based on numerous factors, many of which are beyond our control.

3. User Eligibility and Registration

To use our Services, you must be at least 18 years old and possess the legal authority to enter into binding agreements. By creating an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Each account is intended for use by a single individual only. Sharing accounts or credentials with others is strictly prohibited and constitutes grounds for immediate account termination without refund.

4. User Content

Our Services allow you to submit materials including essays, resumes, personal information, and other content ("User Content"). You retain all ownership rights to your User Content. However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and modify your User Content solely for the purposes of providing and improving our Services. You represent and warrant that your User Content does not violate any third-party rights and that you have all necessary permissions to share such content with us.

5. Intellectual Property Rights

The Services, including all content, features, functionality, software, interfaces, text, graphics, logos, button icons, images, audio clips, data compilations, and code, are owned by or licensed to AdmitStudio.com and are protected by copyright, trademark, and other intellectual property laws. Our Services contain proprietary content, information, and material developed through substantial time, effort, and expense. Unauthorized reproduction, distribution, modification, or creation of derivative works from our Services is expressly prohibited. Nothing in these Terms grants you any right, title, or interest in our intellectual property.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Using our Services for any unlawful purpose or in violation of any applicable laws
  • Sharing your account or access credentials with any other person
  • Copying, distributing, or disclosing any part of our Services in any medium, including by screen captures, recordings, or other methods

7. Subscription Plans and Payment

AdmitStudio.com offers various subscription plans, which may include free and paid options. For paid subscriptions, you agree to pay all applicable fees as described on our pricing page. All payments are processed through secure third-party payment processors. Unless otherwise stated, fees are quoted in U.S. dollars and do not include applicable taxes, which are your responsibility. We reserve the right to change our pricing at any time, with changes taking effect in the next billing cycle for existing subscribers. Subscription fees are non-refundable except as expressly provided in our refund policy.

8. Refund Policy

We offer refunds under limited circumstances at our discretion. To be eligible for a refund consideration, you must:

  • Request a refund within 7 calendar days of initial purchase
  • Have not extensively used the Services (as determined by our usage records)
  • Complete a feedback questionnaire to help us understand your concerns

Refund requests should be submitted to admitstudio.contact@gmail.com. We reserve the right to deny refund requests that do not meet these criteria or that appear to constitute an attempt to use our Services without payment.

9. Term and Termination

These Terms remain in effect while you use the Services. We reserve the right to suspend or terminate your access to our Services at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, suspected fraudulent activity, or disruptive behavior. Upon termination, your right to use the Services immediately ceases. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, liability limitations, and dispute resolution provisions.

10. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components. We do not guarantee admission to any educational institution or any particular outcome from using our Services.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall AdmitStudio.com, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from: (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage. In no event will our aggregate liability exceed the greater of one hundred dollars ($100) or the amount you have paid us in the past six months.

12. Indemnification

You agree to defend, indemnify, and hold harmless AdmitStudio.com and its licensees, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including your User Content, any use of the Services' content, services, and products other than as expressly authorized in these Terms.

13. Copyright Infringement

We respect the intellectual property rights of others and expect users of our Services to do the same. If you believe that material available on our Services infringes your copyright, please notify us at admitstudio.contact@gmail.com with the following information:

  • A description of the copyrighted work you claim has been infringed
  • The location on our Services where the allegedly infringing material is located
  • Your contact information, including email address and phone number
  • A statement that you have a good faith belief that the disputed use is not authorized
  • A statement, made under penalty of perjury, that the information in your notice is accurate

Upon receiving a proper notice, we will promptly remove or disable access to the allegedly infringing material.

14. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the Services shall be resolved through final and binding arbitration, conducted in Wilmington, Delaware, except that you may assert claims in small claims court if they qualify. The arbitration will be conducted by the American Arbitration Association under its rules for consumer disputes. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under these Terms shall be joined to an arbitration involving any other party, whether through class arbitration proceedings or otherwise. You understand that by agreeing to this arbitration provision, you are waiving your right to a jury trial and your right to participate in class actions or class arbitrations.

15. Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Delaware, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware, in each case located in New Castle County, Delaware, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant jurisdiction.

16. Severability

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and AdmitStudio.com regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Services.

18. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. The most current version will be posted on our website with the effective date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to check our website periodically for changes to the Terms.
